This legal notice regulates the use of the website www.webtenerife.com which is owned by SPET, Turismo de Tenerife, S.A. (Turismo Tenerife), registered in the Mercantile Registry of Santa Cruz de Tenerife.

Purpose and acceptance

By browsing the website www.webtenerife.com owned by Turismo Tenerife, you become a user of it and fully accept, without reservation, each of the provisions included in this Legal Notice, which is subject to changes. The user also acknowledges and accepts that they access and use the website and/or the content on it freely and wilfully and under their own responsibility.

The user is bound to make proper and legitimate use of the website and its content, in accordance with the applicable legislation, these Terms and Conditions of Use of the Website, good faith, generally accepted good conduct, public order, uses of traffic and this Legal Notice. The user will therefore be liable vis-à-vis Turismo Tenerife and third parties for any damages caused as a result of failure to comply with these obligations.

Conditions of access and use of the Website.

Turismo Tenerife may establish additional limitations and/or conditions for the use of and/or access to the Website and/or its content, which must be observed by users at all times.

The user acknowledges and accepts that Turismo Tenerife holds all rights relating to the content and/or any other elements posted on the Website (including, but not limited to, brands, logos, trade names, text, images, graphics, designs, sounds, databases software, flow diagrams, presentations, audio and video), consequently, they belong to Turismo Tenerife and/or third parties that authorise Turismo Tenerife to use them on its Website. In no case does access to the Website imply any type of waiver, licence or total or partial transfer of these rights, unless expressly stated otherwise. These Terms and Conditions of Use of the Website do not give users any other rights of use, alteration, exploitation, reproduction, distribution or public communication of the Website and/or its content other than those expressly stated herein. Any other use or exploitation of any other rights will be subject to the prior and express authorisation specifically granted for this purpose by Turismo Tenerife or the third-party holder of the affected rights. For any use other than those expressly permitted, it will be necessary to obtain the prior written consent of the holder of the rights in question.

Turismo Tenerife does not guarantee the availability and continued functioning of the Website or of other Websites linked to it. Furthermore, Turismo Tenerife will in no way be liable for any damages stemming from the unavailability or inaccessibility of the Website, interruptions to the functioning of the Website or IT errors, data access services malfunctions, disconnections, delays or blockages caused by deficiencies or overloads to data access services, the internet or other electronic systems that occur during its operation.

The Website and its services are free to access, however, for certain services, Turismo Tenerife requires the corresponding form to be completed prior to their use. The User guarantees that the data they provide to Turismo Tenerife are accurate and up to date and will be solely responsible for any false or accurate information they provide.

The User expressly agrees to make appropriate use of the content and services offered and not use them to:

  1. Disseminate content that is illegal, violent, pornographic, racist, xenophobic, offensive, advocates terrorism, or in general, which is against the law or threatens public order.

  4. Infringe upon intellectual or industrial property rights or breach the confidentiality of the information of Turismo Tenerife or of third parties.
  5. Impersonate the identity of another User, the public authorities or a third party.
  6. Reproduce, copy, distribute, provide or communicate in any way, transform or modify the Content, unless with the authorisation of the holder of the corresponding rights or it is legally permitted.
  7. Collect data for advertising purposes or to send advertising of any type or communications for sales or marketing purposes without this having been requested or consented to.

Conditions of Access and Use for Blogs, Forums, Chatrooms and other similar services

The main purpose of the Website, blogs, forums, bulletin board, etc. is to create and exchange tourist opinions. To do this, we collaborate with reputable industry professionals, who set out their vision in the field of tourism that affects us. All of the content of every article published on this site is transferred to Turismo Tenerife by our collaborators.

For security reasons, we recommend that users of these sites do not publish confidential information. If detected, confidential information will be erased.

Turismo Tenerife does not guarantee the quality, accuracy, reliability, correctness or morality of the data, information or opinions, whatever their source, that circulate on its Website or on other websites the user is able to access through Turismo Tenerife.

Turismo Tenerife will not be liable for the content set out and the user takes sole responsibility for any consequences, damages or actions resulting from the content, opinions statements or any other information contained on the Website, access to said content, or the reproduction or dissemination thereof.

Turismo Tenerife will not be liable for any user infractions that affect the rights of other Turismo Tenerife users or third parties, including copyright, trademarks, patents, confidential information and any other intellectual or industrial property right.

Without prejudice to the foregoing, users of the Website, blogs, forums, bulletin board, etc. agree to respect these conditions, the legislation in force and generally accepted standards of conduct. In particular, users of these services must not impair the dignity or liberty of others.

In accordance with the foregoing, Turismo Tenerife may exclude any user, statement or content from the Website, blogs, forums, bulletin board, etc. which, in its judgement, affects the principles outlined above, without the need for any justification or explanation. Privacy, Data Protection and Information Society Services Policy.

1. Introduction

To provide its services, Turismo Tenerife needs to gather certain information about you. In this Privacy, Data Protection and Information Society Services Policy, we describe the information we gather, what we do with it and how you can manage and control how your information is used.

The user is informed how Turismo Tenerife, as controller, processes the personal data provided to it through the website www.webtenerife.com , forms and other data it may be provided in future by any authorised means.

Implement Tenerife’s tourism strategy according to the different markets the island receives visitors from, as well as the products to promote in each market. Cooperate with different players in the tourism industry with the aim of creating synergies and establishing alliances.
  • In-Destination Actions: regenerating the destination with the aim of increasing our quality, competitiveness and sustainability as a tourist destination.
  • Economic Promotion: attracting investments for strategic projects (related to renewable energies, knowledge, technology, communications, etc.), giving foreign companies advice on grants, credits and subsidies which they may obtain; and participating in events, trade missions and trade fairs where business opportunities are presented. Promoting the island’s position as a tricontinental platform.
  • Associating with Tenerife-based companies: because through this project, companies, industry professionals and public administrations draw up and agree on the island’s tourism strategy, participate in the evolution of the island’s main economic driver and defend their interests in this field.
  • Offering the best services to its associates by establishing the best internal and external alliances and collaborations.
  • Purposes based on the legitimate interest of the organisation.
  • Reports, Statistics and Specialist Studies.

3. Data Processed by Turismo Tenerife

  • Identity data: full name.
  • Contact data: address, telephone number, fax number, email address.
  • Business data: company, tax identification code, position, directors, postal address, telephone, fax, email address, website, type, category, etc.
  • Preference data: language.
  • Financial data: data we need to process payment for the provision of the service.

4. Responsibility of the User

The user affirms:

  • That the data provided are accurate and undertakes to keep them updated, with Turismo Tenerife not being responsible for the status of these data.
  • That they acknowledge that the data are necessary and mandatory (except in fields where this is indicated otherwise) to provide the service.
  • In the event that the user provides third-party data, the user declares that it has their consent and undertakes to notify the owner of the data of the information contained in this Privacy, Data Protection and Information Society Services Policy, holding Turismo Tenerife harmless from any liability. Turismo Tenerife may conduct the necessary checks, adopting the corresponding measures, in accordance with data protection legislation.

5. Storage of Data

The user’s data will be stored until they fulfil their purpose or until the user requests that Turismo Tenerife erase them, objects, or withdraws their consent.

Your personal data will be blocked when they are no longer necessary for the purpose they were collected for or the user limits their processing, remaining at the sole provision of the Judges and Courts, the Public Prosecutor or the competent Public Administrations, in particular the data protection authorities, to handle any liabilities stemming from the processing, within the limitation period. Once this limitation period has elapsed, your data will be erased.

6. Who will receive your data?

Turismo Tenerife may communicate your data to:

  • Companies in which Turismo Tenerife has holdings or the operators of Turismo Tenerife, solely for internal administrative ends, for the aforementioned purposes or to fulfil legal obligations.

8. Security Measures

Turismo de Tenerife will process user data confidentially and maintain its secrecy in accordance with data protection legislation. The procedural, organisational and technical measures necessary to keep your data secure and prevent their modification, loss or unauthorised processing or access will be applied in accordance with the state of the art, the nature of the data stored and the risks involved.

As a special security measure, Turismo de Tenerife may delete personal data that are not required for the provision of the requested service to guarantee that only necessary data are processed. This measure is particularly relevant for sensitive data, as Turismo de Tenerife does not process or need to process data of this category in order to provide its services. There is no obligation to inform the user of this deletion.
